In these Terms and Conditions “we, our, us, Vital Certificates, "vitalcertificates.co.uk" refers to Vital Certificates Ltd.

Overview

Vital Certificates Ltd is a professional company for the supply of Birth certificates, Marriage certificates and Death Certificates, from various official government sources within Europe. All certificates supplied are certified original copies of microfiche held by the relevant authorities. Order acceptance

Vital Certificates Ltd will only accept orders where it believes that the purpose for which the certificate has been ordered is both bona-fide and legal. For this purpose we ask that you complete all requested fields on our online application form: Failure to complete all fields could result in delay or non acceptance of your order.

Payment Terms

Our sole terms of business exist as pre-payment predominantly by online payment being made at the point of the order via either SagePay or Google Checkout. The payment will appear on your credit card statement as VITALCERTS. Your payment is transacted not on the site of Vital Certificates Ltd but on the site of SagePay (formerly Protx) or Google in all circumstances. Other forms of acceptable payment are Cheque or BACS transfer, in advance in all circumstances.

Delivery

Using the various mailing systems in Europe we will despatch the requested record(s) to the address requested on the given order, addressed to the person requested on the order. We do not offer and are unable to supply a pick up service. Delivery times quoted are given in good faith and whilst in around 95% of the ordered products are adhered to they do not form part of our contract the given time is based on working days and is deemed to commence on the next working day following receipt of order

Problems

We ask that you allow the given period for the despatch of your ordered certificate in the majority of case we dispatch prior to the quoted period. Should your request be late in arriving or you have question relating to a delivered order please feel free to contact us.

Where a certificate is not registered or does not match the given details we will be unable to supply the requested certificate. In certain circumstances, particularly England and Wales, the 50 year rule applies. This means that you must supply us with all of the required details.

All orders are subject to an administration fee which Vital Certificates Ltd reserves the right to retain of GBP £10.00 + VAT (£20.00 + VAT for priority and consular orders) per document. The remainder of any payment will be credited. Therefore, please be sure the information supplied is both accurate and complete and that the period in which your document was registered is covered within the stated product page. Vital Certificates Ltd cannot accept any responsibility for false, inaccurate or incomplete information supplied.

In the event that you have any issues or problems with the delivery service Vital Certificates has supplied you, we require written advice from you within 90 days from the date of dispatch of your order. We reserve the right to destroy any document relating to an order 90 days from the date of service dispatch or following attempts to dispatch.

Where your order includes consular or apostille services from an Embassy, Consulate or other UK or overseas government office, Vital Certificates cannot be held responsible for any delays whilst documents are awaiting legalisation or attestation. Delays include, but are not limited to, inability for the Embassy or Consulate to complete the legalisation or attestation for any reason, delays due to observed local public holidays, or incorrect/incomplete knowledge of advised legalisation processes. Where an Embassy or Consulate advises of consular surcharges, typically for non-standard or company documents, Vital Certificates reserves the right to pass on such additional charges to you. Any additions will be verifiable with the Embassy or Consulate directly.

Contract of Order

The point at which an order shall be deemed to have commenced is the point at which the order arrives on the server of Vital Certificates Ltd with the relevant payment accepted on the server of either SagePay or PayPal, our online secure servers. Because of the way that we work the contract is deemed to commence at this point and regulation 13 of the distance selling and home ordering regulations are deemed to apply and Vital Certificates Ltd does not offer the right to cancel once the order has been made.

Deed Poll Acceptance Guarantee

We guarantee that any Deed Poll produced by us will be accepted by any official UK government department or UK business. This is reliant on the Deed Poll being completed and executed correctly by the customer and can not take any responsibility for any Deeds which have been not been accepted due to customer error. We do supply a guide with every order to help you complete it correctly, and offer ongoing support.

If your Deed is rejected by a company, and has been completed and executed correctly, we reserve the right to see a copy of any rejection notice. This will allow us to attempt to resolve the issue and make sure it is accepted for you. It may be that the company you are dealing with are not familiar with Deed Polls and issues can usually be resolved via direct communication.

If a Child's Deed Poll is rejected, the guarantee does not cover any situations where you have not correctly obtained permission from everyone who holds Parental Responsibility, or supplied a consent letter with the Deed Poll which meets requirements. We provide a guide via email with every order on how to create these documents and offer ongoing support.
